Ban ATVs from Forest Preserve (A.916)

Legislative Description: Prohibits the operation of all-terrain vehicles by the general public in the state forest preserve, Long Island central pine barrens area and Albany pine bush preserve; grants exceptions for the disabled, official purposes and law enforcement; provides for the impoundment of all-terrain vehicles operated in violation of such provisions and the imposition of a $100 surcharge upon the owner thereof; provides for the deposit of such surcharges into a separate all-terrain enforcement fund. Amd SS9-0303, 46-0111 & 57-0121, add S71-0717, En Con L.

Cowboy Notes: This bill does some good things like banning ATVs from "sensitive environmental areas" like the Albany Pine Bush the alike, however it also bans ATVs from all forests preserves except where allowed by other laws. That might be the effective policy as it stands now, but it sets a bad precedent against riding opportunities. No Senate sponsor, did not pass last session. Certainly the off-road folks don't want this bill. 52

Bans ATVs on School Grounds (A.1492 / S.578)

Legislative Description: Prohibits the operation of all-terrain vehicles on school grounds, and baseball, football and soccer fields, without the permission of the owner thereof, provided that the owner or lessee has erected "No Trespassing" signs thereon. Amd S2403, V & T L.

Cowboy Notes: Magee's anti-ATV bill that would ban ATVs on school grounds and other properties. It's not a priority, but still it's the kind of bill certain constituencies like. 52

Exempt ATV Registration For Own Land Use (A.3307)

Legislative Description: Establishes the crime of unlawful possession of an identity scanning device; defines "identity scanning device" as a device that can access a person`s financial services account number or code and other personal information; makes such unlawful possession a class E felony. Add S190.85, Pen L.

Cowboy Notes: Bill would exempt ATV owners from having to register their vehicles if they were only going to use it on their own land (ie. farmers). There is less of a practical need for the state to have registration records for ATVs used on private land, and snowmobiles used exclusively on one own farm are exempt from such registration.

And as we all know, ATVs are very popular vehicles around the farm. They make for fast and easy ways to get from place to place, and many of them have all kinds of attachments from snow plows to mower decks. Not to mention they are a fun way to herd cattle around. No Senate bill, no co-primes or multi-sponsors on the bill suggest limited support fo it. 52

Republican ATV Trail Fund Proposal (A.3811)

Legislative Description: Provides for the development and maintenance of trails for all terrain vehicles through the office of parks, recreation and historic preservation; provides state assistance for local enforcement of laws relating to all terrain vehicles and for safety education programs; requires the commissioner of parks, recreation and historic preservation to establish a map of all terrain vehicle trails; requires all terrain vehicles to bear registration plates; authorizes the impoundment of all terrain vehicles for violations of law committed therewith; establishes the all terrain vehicle trail development and maintenance fund and appropriates $10,000,000 thereto; authorizes the commissioner of environmental conservation to promulgate regulations to protect the state`s natural resources from all terrain vehicles; eliminates the annual registration fee for all terrain vehicles.
