Cowboy Notes: This is the burn barrel ban proposed by the Assembly years ago first by Susan John of Rochester in 1995 or earlier (LRS only goes back to 1995) and has passed the Assembly every year since -- abit modified to specifically exclude ag waste burning.

Despite what some environmentalists claim, it's a big handout to solid waste haulers for something that the environmental impact is well overstated. It's anti-rural legislation. And if you don't like your neighbor burning trash, either move to the city or take it up with him.

This bill is different from the Senate bill in the following way: it bans the burning of all solid waste and not just household solid waste. Right now, commercial and industrial open burning of solid waste is prohibited, agriculture and residents of towns less then 20,000 are exempt. This bill would ban both the burning of non-organic ag waste (like silage wrap or plastic bailing twine) and all residential waste burning. It's not going to get past the Republican Senate but it's possible the Senate could change hands this year. 31

Farmers want to still be able to burn trash, particularly agricultural wastes -- some organic and some like ag plastics.

From the bill: Household solid waste" means solid waste discarded from single or multiple dwellings, hotels, motels, campsites, public and private recreation areas, ranger stations and other residential sources. So don't even think of tossing that dirty diaper in your campfire but feel free to burn as much silage plastic as you can get your hands on ! The Senate companion nor the Assembly bill has never made it to the floor of the Senate. The official position of the Senate is that it isn't a good bill. 31
